By accessing or using Skila ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, teachers, students, school administrators, and others who access or use the Service.
2.1 Account Creation: When you create an account, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.
2.2 Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
2.3 Age Requirements: Users under 13 years of age must have parental or guardian consent and must use the Service under adult supervision. Teachers and school administrators are responsible for obtaining necessary parental consents for student users.
2.4 Account Types: The Service offers different account types including Student, Teacher, School Administrator, and Parent accounts. Each type has specific permissions and responsibilities.
3.1 Purpose: Skila is designed for educational purposes, including creating quizzes, flashcards, courses, and other learning materials for K-12 education.
3.2 Teacher Responsibilities: Teachers are responsible for the content they create and share with students. All content must be appropriate for educational settings and comply with school policies.
3.3 Student Conduct: Students must use the Service respectfully and for legitimate educational purposes. Cheating, sharing quiz answers inappropriately, or misusing the platform is prohibited.
3.4 AI-Generated Content: The Service uses AI to generate educational content. While we strive for accuracy, users should review AI-generated content for appropriateness and correctness before use.
4.1 Service Content: The Service and its original content, features, and functionality are owned by Skila and are protected by international copyright, trademark, and other intellectual property laws.
4.2 User Content: You retain ownership of content you create using the Service. By uploading or creating content, you grant Skila a non-exclusive license to use, display, and distribute that content within the Service.
4.3 Shared Content: When you share quizzes or materials via the Template Marketplace, you grant other users the right to use and adapt that content for educational purposes.
You agree NOT to:
6.1 Virtual Points: Points, XP, badges, and other virtual rewards earned through the Service have no monetary value and cannot be exchanged for cash.
6.2 Trading Cards: Virtual trading cards are for entertainment and motivation purposes only. They cannot be sold or exchanged for real currency.
6.3 Leaderboards: Participation in leaderboards and competitions is voluntary. Rankings are based on legitimate activity within the Service.
7.1 Service Availability: The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
7.2 Educational Content: While we strive for accuracy, we do not guarantee that all educational content, especially AI-generated content, is error-free. Users should verify important information.
7.3 Limitation of Liability: To the maximum extent permitted by law, Skila shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
8.1 Free Tier: Basic features are available for free. Premium features may require a paid subscription.
8.2 Billing: Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for the subscription fee.
8.3 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
8.4 Refunds: Refunds are provided at our discretion. School and district subscriptions may have different refund policies as specified in their agreements.
9.1 By You: You may terminate your account at any time by contacting us or using the account deletion feature.
9.2 By Us: We may suspend or terminate your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
9.3 Effect of Termination: Upon termination, your right to use the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes.
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
